Lucknow: In a significant development, the Lucknow Bench of the Allahabad High Court on Friday observed that allegations surrounding Congress leader Rahul Gandhi’s alleged dual citizenship merit a thorough probe, directing the Uttar Pradesh government to take action.

The court asked the state government to either conduct an investigation on its own or refer the matter to a central agency, underscoring the seriousness of the claims.

Petition Challenges Lower Court Refusal

The directive came while hearing a petition filed by BJP worker S. Vignesh Shishir, who challenged a January 28 order of a special MP/MLA court in Lucknow. The lower court had declined to order registration of an FIR, stating that questions related to citizenship fall beyond its jurisdiction.

Multiple Laws Invoked

In his plea, the petitioner has sought registration of an FIR and a comprehensive investigation under several legal provisions, including the Bharatiya Nyaya Sanhita, the Official Secrets Act, the Foreigners Act, and the Passport Act.

He claims to possess documentary evidence, including purported emails linked to UK authorities, which allegedly indicate that Gandhi may have held British citizenship.

Question Over Electoral Eligibility

The petition further argues that if the allegations are proven, it could have serious constitutional implications. Under Indian law, a foreign national cannot contest elections or hold public office, raising questions over Gandhi’s eligibility as a Member of Parliament.

Case Background

The matter was originally filed before a special MP/MLA court in Rae Bareli. On December 17, 2025, the high court transferred the case to Lucknow. Following the dismissal of his plea by the Lucknow court, the petitioner moved the high court, which has now called for a probe into the allegations.

The case is likely to draw political and legal attention in the coming days as authorities decide the course of investigation.
